PRODUCT RETURNS

1. Return Policy. We take pride in our Modern Luxe products and want you to enjoy using them. All of our products carry a 30-day return policy. If you are not satisfied with a product you purchased from getmodernluxe.com, you can return it for a refund within 30 days of your receipt of the product. Due to the nature of some of our products, products that have been opened or used may be subject to a 15% restocking fee. To the extent allowed by applicable law, products purchased from an unauthorized retailer are not covered by our return policy.

2. Returns Process. Refunds will be returned to the original form of payment. For exchanges, return your product for a refund and place a new order on modernluxe.com for the correct item.

To initiate a product return contact our customer support team at: [email protected]. In your email, include: (1) your name, (2) phone number, (3) Order ID, (4) product you wish to return, (5) proof of purchase, and (6) a brief summary of your reason for return. If your request is approved, we will issue you a Return Material Authorization (RMA) or a Defective Material Authorization (DMA) tracking number.

We reserve the right to limit returns, and to track returns initiated from the same name, email address, billing address, mailing address, or IP address. If we believe that a customer or potential customer has been or is likely to take advantage of our return policy, or otherwise purchase products for reasons other than personal use, we reserve the right to deny sales or returns to any customer.

Refunds are processed within approximately 3 business days of our receipt of your merchandise. Your refund will be credited back to the same payment method used to make the original purchase on the Site. [WE OFFER NO REFUNDS ON ANY PRODUCTS DESIGNATED ON THIS SITE AS NON-RETURNABLE.]

LUXE LIMITED WARRANTY

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP THAT MAY PREVENT USE OF THE PRODUCT.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR, OR REPLACEMENT, OR REFUND AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

WHO MAY USE THIS WARRANTY?

Modern Luxe Products located at address 32332 Camino Capistrano, Suite #101, San Juan Capistrano, California 92675 (“we”) extend this limited warranty only to the consumer who originally purchased the product (“you”). It does not extend to any subsequent owner or other transferee of the product. Proof of purchase may be required for a return DMA.

WHAT DOES THIS WARRANTY COVER?

This limited warranty covers defects in materials and workmanship of The Luxe Roll and The Travel Stand for the Warranty Period as defined below.

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; or (h) external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

WHAT IS THE PERIOD OF COVERAGE?

This limited warranty starts on the date of your purchase and lasts for 18 months (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

With respect to any defective product during the Warranty Period, we will, in our sole discretion [, either: (a)] repair or replace the product (or the defective part) free of charge [or (b) refund the purchase price of the product]. We will also pay for shipping and handling fees to return the repaired or replacement product to you if we elect to repair or replace the defective product.

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must call us at ‪(949) 329-8052 or email our Customer Service Department at [email protected] during the Warranty Period to obtain a Defective Merchandise Authorization (“DMA”) number. No warranty service will be provided without a DMA number. Once you have received your DMA number, send your package to the return address at 32332 Camino Capistrano, San Juan Capistrano CA 92675. Once we receive your package, we will either fix, replace, or provide a refund for the product.

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

The following informal dispute resolution procedure is available to you if you believe that we have not performed our obligations under this limited warranty: Send us an email to [email protected] with the subject line “Warranty Service Dispute” or call us at ‪(949) 329-8052‬. You must use this informal procedure before pursuing any legal remedy in the courts.
